This case is different from the case in which SC raised objections ("pyjama string doesn't prove" logic). The article is mixing the two for sensationalism.

In this case, if the victim is accepted by the Honble court as being intoxicated ("since she needed support"), then it cannot consider her consent as valid as per the language in the IPC / BNS sections, and has to be treated as rape if there was sexual intercourse. IMO.

And "she herself invited trouble" is disturbing language to be used by a judicial officer about a rape victim.

The Allahabad High Court recently granted bail to a rape accused on the condition that he marries the victim within three months of his release.

Justice Krishan Pahal passed the order on February 20 after the accused, a 26-year-old man, said he “as a bonafide person, is ready to take care of the victim as his wedded wife”.

“The applicant shall marry the victim within a period of three months of his release from jail,” the Court said in one of the bail conditions as it ordered release of the accused.

However, the order is silent on why such direction was passed and whether the complainant was heard by the Court. 

The accused, Naresh Meena alias Narsaram Meena, was arrested in September 2024 in connection with a case registered by Agra Police under Section 376 (rape) and Section 506 (criminal intimidation) of the Indian Penal Code along with Section 67 of the Information Technology Act. 

The case was registered at Khandauli Police Station in Agra

As per the prosecution, Meena lured the victim by promising to help her get recruited into the Uttar Pradesh Police, took ₹9 lakh from her, sexually assaulted her and later circulated an obscene video of her on social media.

During the bail hearing, Meena’s counsel argued that the allegations were false. He also cited a delay of four months in filing the FIR.

The Court in the order said the State could not bring forth any exceptional circumstances which would warrant denial of bail to the accused.

“It is settled principle of law that the object of bail is to secure the attendance of the accused at the trial. No material particulars or circumstances suggestive of the applicant fleeing from justice or thwarting the course of justice or creating other troubles in the shape of repeating offences or intimidating witnesses and the like have been shown by learned AGA.”

Considering the absence of Meena’s prior criminal record and the principle that “bail is a rule, jail as an exception”, the Court granted the accused bail.

"The well-known principle of "Presumption of Innocence Unless Proven Guilty," gives rise to the concept of bail as a rule and imprisonment as an exception," the single-judge said.

A boy who is not able to respect others and who don't know how to behave with others is granted bail only for his marriage to his victim. 

There are a lot of cases where girls are subjected to marital rape. Don't confuse here, I know it's legal to have physical relation with your spouse but there are also some dos and donts. 

Rape means a person is having physical relation without the other's consent. So I personally don't believe he'll care about her consent. 

Last time,  I was watching a video where the anchor told that the boy was so brutal in his wedding night that the girl had to spend next 1 month in the hospital where doctor told she has multiple vaginal and anal injuries and it was very painful for her to bear that. 

In my opinion, the court just gave a license to him to do everything with her.

How is this just rape? How is no previous criminal charges a reason for bail and the condition. If the ₹9 lakh amount is proven or video proven. The guy shouldn't have access to social media at all, how does court prevent when he is on bail. The guy doesn't need to run, he will just force the girl to drop the case.

This is wrong on so many levels and leaves things unclear. Rape by definition is about domination and power dynamics. Violent or not, how can the court trust that he will actually take care of this woman?

Secondly, rape is traumatic, so why have the poor victim relive her trauma every day? We could consider the opposite as well, that this is a meticulously laid trap and the court in all of its stupidity has gone ahead. 

More likely is that the Judge(s) may be living out their moral and potential domination fantasies through their judgements. 

And this is condition for bail, so do they intend to continue the prosecution? If so, won’t this get messier? The victim could take the case back or provide biased testimony- leading to his acquittal and then he’s free to treat her how he likes or file for divorce. 

Or less likely that he is arrested. So then will the judges order the neighbours to marry her??

Let me set the context. You all might have heard about, 'pakadua vivah' that happens in bihar and nearby areas. Where a govt employee are kidnapped and made to marry girls.


Similar is case here with a twist, girls are filing fake cases, with too many legal underpinnings, due to Indian laws favoring girls.

Judges can either put the boy in jail and let the case drag for years and after that release them if case is decided in their favour.

Or, they can do such kangaroo justice, and make them marry the girl, who filed false case against them.


Although this is wrong, but unless and Untill gender neutral laws are drafted and come into force, cases like these will keep happening.

should have and likely would have are very different things, especially when it comes to rape charges.  i have personally attended somewhere between ten and twenty sexual assault hearings where the evidence was more compelling than what you've listed, and where no conviction resulted.

in terms of your three bullets, the last one is irrelevant, because it was after the charges were dropped. he certainly would not have said that at trial (he may not have said anything at all).  the second is relevant, but not dispositive because verbal consent wasn't required.  the first one is relevant certainly, but then again, there was no trial.  bryant's team definitely would not have missed the opportunity to make the entire trial about the accuser, turn it into a massive media circus, and manufacture all kinds of ways to make the accuser look like a liar.  bryant either would not have testified or he would have testified after extensive trial prep by the best trial attorneys in the country.  the accuser would have had her interests represented by the state, which had already demonstrated a bias in favor of Bryant during the aftermath of the report.

all in all, i think you're being extraordinarily optimistic about how rape trials proceed.  the accuser chose not to move forward for a reason; specifically, that the thing having happened is only a small part of a conviction actually being obtained.
